360 CREATIONS may provide creative services including, but not limited to:

• Digital artwork
• Portrait and artistic design

• Other creative and design services

3. Custom Design Projects

When you request a custom design service, you agree to provide accurate information, content, references, specifications, and materials required to complete the project. Depending on the project, you may be asked to provide:

• Business name
• Logo or existing branding
• Text/content
• Images
• Design references
• Preferred colors
• Dimensions/specifications
• Required file formats
• Other project requirements

3. Custom Design Projects — scope

The final deliverables will be based on the agreed project scope. Requests that substantially change the originally agreed scope may require an additional fee or revised delivery timeframe.

4. Revisions

The number of revisions included in a project will depend on the package or agreement selected. A revision means a reasonable modification to the existing agreed design. A completely new concept, substantially different direction, or change in the original project requirements may be treated as additional work. Revision limits, where applicable, will be communicated before or during the project.

5. Project Delivery

Estimated delivery times will depend on:

• Project complexity
• Selected service/package
• Client response time
• Availability of required information
• Number of revisions
• Technical requirements

5. Project Delivery — estimates

Delivery estimates are not guaranteed deadlines unless a specific deadline has been expressly agreed. Delays caused by missing information, delayed feedback, or client-requested changes may extend the delivery timeframe.

6. Client Responsibilities

Clients are responsible for ensuring that all materials they provide to 360 CREATIONS may legally be used for the requested project. This includes photographs, logos, fonts, text, illustrations, videos and other copyrighted material. 360 CREATIONS is not responsible for copyright or intellectual-property violations arising from materials supplied by a client.

7. Payments

Payment requirements will be communicated before a project begins or at the time of purchase. Where online payment is available, payments may be processed through third-party payment providers such as PayHere. Payment information such as full card numbers, CVV codes, or banking credentials is not intentionally collected or stored by 360 CREATIONS. Payment-provider terms may also apply to transactions processed through their systems.

8. Digital Products

360 CREATIONS may offer digital products such as graphic design resources, templates, artwork, editable design files, print-ready files, digital assets and other downloadable creative products. The exact contents of each digital product will be described on its individual product page. Unless specifically stated otherwise, purchasing a digital product does not transfer ownership of the underlying copyright or intellectual property to the purchaser. The purchaser receives only the rights/licence specifically stated in the product description or accompanying licence terms.

9. Digital Product Restrictions

Unless explicitly permitted by the product licence, customers may not:

• Resell the original digital files
• Redistribute the files
• Upload the files to file-sharing websites
• Give the files to other people
• Claim the original artwork as their own
• Use the files to create a competing downloadable product
• Remove copyright or ownership notices
• Make the original files publicly available

9. Digital Product Restrictions — licences

Different products may have different licensing terms. Where a product-specific licence conflicts with these general terms, the product-specific licence will apply to that product.

10. Portfolio and Intellectual Property

All original designs, artwork, graphics, photographs, website content, branding elements, and other materials created by 360 CREATIONS remain protected by applicable intellectual-property rights. For custom client projects, ownership or licensing of the final deliverables will depend on the agreement made for that project.

10. Portfolio and Intellectual Property — what does not transfer

Unless otherwise agreed, payment for a design service does not automatically transfer ownership of:

• Unused concepts
• Rejected concepts
• Working files
• Internal design explorations
• Source files not included in the agreed deliverables
• Third-party assets

10. Portfolio and Intellectual Property — third-party assets

Third-party fonts, stock assets, software, images, or other licensed materials remain subject to their respective licences.

11. Portfolio Display

360 CREATIONS may display completed client work in its portfolio, website, social media, promotional material, or other marketing channels unless a confidentiality agreement or other written agreement states otherwise. If a client requires a project to remain confidential, this should be communicated before or during the project.

12. Website Content

We make reasonable efforts to keep website information accurate. However, product descriptions, prices, availability, service offerings, and other information may occasionally contain errors or require updates. 360 CREATIONS reserves the right to correct errors and update website information when necessary.

13. Website Security and Unauthorized Use

Users must not attempt to:

• Gain unauthorized access to the website
• Circumvent authentication systems
• Access restricted administrative areas
• Interfere with website functionality
• Upload malicious code
• Scrape or systematically copy protected content
• Attempt to obtain private original design files
• Circumvent digital-product access controls

13. Website Security — watermarks

Portfolio images may contain watermarks or other protective measures. These measures are intended to discourage unauthorized use, but no online system can guarantee that content cannot be copied or captured.

14. Accounts

If the website allows customers to create accounts, customers are responsible for keeping their login credentials secure. Customers should immediately notify 360 CREATIONS if they believe their account has been accessed without authorization. We reserve the right to suspend or terminate accounts involved in fraudulent, abusive, or unauthorized activity.

15. Third-Party Services

The website may use third-party services for purposes such as payment processing, hosting, authentication, file storage, analytics, email communication and other technical services. Third-party services may have their own terms and privacy policies.

16. Refunds

Refunds are governed by our separate Refund / Return Policy. By purchasing a product or service, you acknowledge that the Refund / Return Policy applies to your transaction.

17. Limitation of Liability

To the extent permitted by applicable law, 360 CREATIONS will not be responsible for losses caused by circumstances beyond reasonable control, including service interruptions, third-party platform failures, internet outages, unauthorized access, or events outside our reasonable control. Nothing in these Terms is intended to exclude or restrict any rights that cannot legally be excluded or restricted.

18. Changes to These Terms

360 CREATIONS may update these Terms & Conditions when necessary. The updated version will be published on this page with a revised "Last Updated" date. Continued use of the website after an update constitutes acceptance of the updated terms, subject to applicable law.
